Will Writing is certainly a skill. First and foremost the will has to ensure that it’s going to do what you want it to do as tax efficiently as possible.

Each year Budgets and Financial Acts change the rule books, as such wills should be reviewed even if you have made one in the past.

Certainly without a will you are in a precarious situation, leaving everything to the government to handle your estate ( this is called intestacy) and strict rules are enforced.

One thing that is most important with will writing is to obtain accurate information and to ensure that the assets you own can be given away under your respective will. Many people incorrectly assume that their house can be passed by their will. ( it can but it depends how the property is held) otherwise the property will pass according to the property succession law and not that of your will.  

It is therefore very important to ensure that the property is held as you wish, to ensure that the property ( if you wish) can be gifted according to your wishes within the will.

Many clients request that their children are protected and that sometimes a Trust is set up to (Minimise Tax, Protect Disabled Children, set up a Family Trust Fund, Protect Business Assets, Protect Farming Assets etc) we can assist you to safeguard your children’s inheritance  and  to protect the children if they were minors by appointing Guardians that are responsible for the upbringing of your children should you die prior to the children reaching the age of 18.

Parental responsibility is extremely important and whether single, married or civil partner’s you need to consider in your will if you have responsibility of children, as to who legally is responsible for their care. ( please be aware if single with children as certain restrictions may apply as to who has the legal responsibility and it may not be who you think?)

Anyone who is a director of a company requires special care, when making a will, as it is not always the case that your will can pass your shares to who you wish.
